Terms of Service

These Terms of Service (“Terms”) govern your use of Tally, operated by Tally Applications, LLC (“Tally,” “we,” “us”). By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use Tally.

1. The service

Tally is a nutrition and calorie tracking app that helps you log food quickly and provides estimates of calories and nutrients to support your goals.

Not medical advice. Tally provides estimates and general wellness information only — it is not medical, nutritional, or dietary advice, diagnosis, or treatment. Nutrition values are estimates and may be inaccurate. Always consult a qualified healthcare professional before making decisions about your diet or health. You use Tally at your own discretion.

2. Your account

You must provide a valid email address and are responsible for activity that happens under your account. Keep your access secure. Accounts are for individual use.

3. Free trial, subscriptions & billing

Tally offers a 5-day free trial. When you sign up on our website you choose a plan and provide a payment method up front. You have full access to the app during the trial, and nothing is charged until the trial ends. Cancel before then and you pay nothing.
Plans are $19.99 per month or $129.99 per year (or as shown to you at the time of purchase). Subscriptions automatically renew until you cancel.
Web subscriptions are processed by Stripe. If you instead subscribe inside our iPhone app, that purchase is processed and billed by Apple under their terms, and any discount or promo code offered on our website does not apply to it.
You can cancel anytime — in the app (Profile → Manage subscription) for web subscriptions, or through your Apple account for App Store purchases. Cancellation takes effect at the end of your current billing period, and you keep access until then.
Prices may change; we will provide notice as required by law before a change affects you.

4. Refunds

Please see our Refund Policy. In short: the free trial is your risk-free tryout, and you also get a 14-day money-back guarantee on any charge — if you cancel within 14 days of being charged, we refund it in full. After that window, charges are non-refundable, though you can cancel anytime to stop future renewals. Purchases made through Apple follow Apple's refund policy.

5. Acceptable use

You agree not to misuse the service, including not to reverse-engineer, resell, overload, or attack it, and not to use it for any unlawful purpose.

6. Your content

Your data is yours. By using Tally, you grant us the permission needed to store and process your data to operate the service, as described in our Privacy Policy.

7. Intellectual property

Tally, its name, branding, and software are owned by us. We grant you a limited, personal, non-transferable license to use the app for its intended purpose.

8. Disclaimers

The service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind. We do not guarantee the accuracy of estimates or that the service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Tally and Tally Applications, LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

10. Termination

We may suspend or terminate access for violations of these Terms. You may stop using Tally and cancel your subscription at any time.

11. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of Tally after an update means you accept the revised Terms.
